Plaintiff Kyle Van Vlack, a formerly employed NINJARMM (now d/b/a NINJAONE), Inside Sales Representative working as a Sales Development Representative (SDR) from the Clearwater, Florida office has filed this National FLSA Collective Action against NINJARMM LLC d/b/a NINJAONE, individually, and on behalf of all persons presently employed and those persons formerly employed with NINJAONE as Inside Sales Reps (ISR) under any of these job titles: Account Manager, Account Executive, Sales Development Representative (SDR) related to claims for UNPAID OVERTIME hours. Mr. Van Vlack, who is NOW joined by 5 other SDR who have joined this case, alleges that as an SDR, he was willfully misclassified as a salaried-exempt employee and permitted to suffer to work many overtime hours each week without being paid overtime pay (aka premium pay) for all overtime hours worked each week in a clearly unlawful and willful violation of the mandatory overtime wage requirements under the FLSA. As the Complaint spells out, the law is clear under the FLSA: inside sales reps are non-exempt and must be paid overtime pay and overtime premiums for all hours worked over 40 in each and every workweek.
As part of our continuing investigation into the alleged FLSA wage violations by NINJAONE and in an effort to gather evidence in support of our position and corroborate facts about its pay practices, we are in need of speaking to as many Inside Sales Reps (ISR) as possible. We seek to determine if the positions and job duties/requirements are similar for all the various job titles used, as well to investigate and determine if the alleged unlawful pay practice at issue here is pervasive and long standing at NINJAONE. You are someone who has valuable information as a witness to the alleged unlawful pay practices. The law, and 1st AMENDMENT of the US Constitution permits attorneys in FLSA class/collective actions to communicate in this form with the class members (current and former employees) before certification.
